BUILTCRM TERMS OF SERVICE

We build and set up a CRM for your business based on our template. What's included depends on your package (Standard or Pro) as listed on builtcrm.app at the time of purchase, or on a signed Statement of Work (Custom). Anything not listed is not included.

To deliver your CRM, you will:

• Create accounts in your own name for code hosting (e.g. GitHub), database (e.g. Supabase), web hosting, domain, SMS and email providers, and give us access.
• Provide the information listed on our setup page (builtcrm.app/setup).
• Answer our questions within a reasonable time.

Delivery dates move if these are delayed. If we don't receive what we need within 60 days of payment, we may close the project. Payments stay non-refundable.

Handover is the day we email you that your CRM is set up on your accounts. You then have 14 days to test it.

A bug is a feature included in your package that doesn't work as described. Report bugs to hello@builtcrm.app during the 14 days and we fix them at no extra cost, even if the fix is finished after the 14 days.

New features, design changes and change requests are not bugs.

After 14 days, the work is considered accepted. Later fixes and changes are paid work.

Standard and Pro are paid in full upfront through Stripe. Custom is paid as stated in its Statement of Work. Prices are in USD.

All payments are final and non-refundable. Our obligation is to fix bugs as described in Section 3.

Your data: everything you and your customers enter into the CRM belongs to you.

Custom work: after full payment, you own the code we write only for you.

Our template: your CRM is built on our pre-existing template, components and know-how ("BuiltCRM Template"). We keep all rights to it and may use it for other clients. After full payment, you get a perpetual, irrevocable, royalty-free license to use, copy, modify and run the BuiltCRM Template as part of your CRM for your own business.

You may not resell, sublicense or offer the CRM or the BuiltCRM Template as a product or service to others.

Your CRM runs on services you hold accounts with (hosting, database, SMS, email, maps, AI, payments). You pay them directly under their own terms. We are not responsible for their uptime, prices, policy changes or data handling. If a provider changes or ends a service, updating your CRM is paid work.

• Sales tax: the CRM calculates tax from the rates and regions set in it. You are responsible for checking rates and for filing and paying taxes. We are not tax advisors.
• Texts and calls: you are responsible for getting your customers' consent and following the TCPA, carrier rules (such as A2P 10DLC registration) and other laws.
• AI features: AI tools, including voice agents, can make mistakes. You are responsible for monitoring them and for their results.
• Customer privacy: you are responsible for privacy notices and laws that apply to your business.

We access your accounts and data only to deliver and support our services. We keep your non-public information confidential and never sell it. After acceptance you can remove our access at any time.

You may change the code yourself or hire anyone to do it. We are not responsible for changes made by you or others. Work from us after acceptance is quoted in advance.

Except for bug fixes under Section 3, our services and the CRM are provided "AS IS", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation.

To the maximum extent allowed by law, our total liability for any claim is limited to the amount you paid us for the services related to that claim. We are not liable for indirect, incidental, special or consequential damages, including lost profits, revenue, data, or tax penalties.

You will defend and hold us harmless from claims arising from your use of the CRM, your messages and calls to customers, your handling of customer data, or your breach of these Terms.

We may say that we built a CRM for your business, without showing your data. Email us if you'd rather we didn't.

These Terms and any signed Statement of Work are the entire agreement. If they conflict, the Statement of Work wins for Custom projects. These Terms are governed by the laws of the State of Arizona. We may update these Terms; the version you accepted at purchase applies to your purchase.
